Your statutory rights and entitlements under any defined service feature (for which additional payment has been made) are not affected.<\/span><\/p><p data-path-to-node=\"1\"><span style=\"color: #000000;\">\u201cShipment\u201d means all documents or parcels that travel under one waybill and which may be carried by any means Swift Trust Movers chooses, including air, road or any other carrier. A \u201cwaybill\u201d shall include any paper waybill produced by Swift Trust Movers automated systems or via the Internet, airway bill, or consignment note and shall incorporate these Terms and Conditions. Every Shipment is transported on a limited liability basis as provided herein.<\/span><\/p><p data-path-to-node=\"2\"><span style=\"color: #000000;\"><b data-path-to-node=\"2\" data-index-in-node=\"0\">Customs, Exports and Imports<\/b> Swift Trust Movers may perform any of the following activities on Shipper\u2019s behalf in order to provide its services to Shipper:<\/span><\/p><ul data-path-to-node=\"3\"><li><p data-path-to-node=\"3,0,0\"><span style=\"color: #000000;\">Complete any <span class=\"citation-1311 citation-end-1311\">documents, amend product or service codes, and pay any duties or taxes required under applicable laws and regulations;<\/span><\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"3,1,0\"><span style=\"color: #000000;\"><span class=\"citation-1310 citation-end-1310\">Act as Shipper\u2019s forwarding agent for Customs and export control purposes and as Receiver solely for the pur<\/span>pose of designating a Customs broker to perform Customs clearance and entry; and<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"3,2,0\"><span style=\"color: #000000;\">Redirect the Shipment to Receiver\u2019s import broker or other address upon request by any person who Swift Trust Movers believes in its reasonable opinion to be authorised.<\/span><\/p><\/li><\/ul><p data-path-to-node=\"4\"><span style=\"color: #000000;\"><b data-path-to-node=\"4\" data-index-in-node=\"0\">Unacceptable Shipments<\/b> <span class=\"citation-1309 citation-end-1309\">Shipper agrees that its Shipment is acceptable for transportation and is deemed unacceptable if:<\/span><\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><ul data-path-to-node=\"5\"><li><p data-path-to-node=\"5,0,0\"><span style=\"color: #000000;\"><span class=\"citation-1308\">It is classified as hazardous material, dangerous goods, prohibited <\/span><span class=\"citation-1307 citation-1308 citation-end-1308\">or restricted articles by IATA (Interna<\/span><span class=\"citation-1307 citation-end-1307\">tional Air Transport Association), ICAO (International Civil Aviation Organisation), any applicable government department or other relevant organisation;<\/span><\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"5,1,0\"><span class=\"citation-1306 citation-end-1306\" style=\"color: #000000;\">No Customs declaration is made when required by applicable Customs regulations;<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"5,2,0\"><span style=\"color: #000000;\">Or Swift Trust Movers decides it cannot transport an item safely or legally (such items include but are not limited to: animals, bullion, currency, bearer form negotiable instruments, precious metals and stones, firearms, <span class=\"citation-1305 citation-end-1305\">parts thereof and ammunition, human remains, pornography and illegal narcotics\/drugs).<\/span><\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><\/ul><p data-path-to-node=\"6\"><span style=\"color: #000000;\"><b data-path-to-node=\"6\" data-index-in-node=\"0\"><span class=\"citation-1304 citation-end-1304\">Deliveries &amp; Undeliverable Shipments<\/span><\/b> <span class=\"citation-1303\">Shipments <\/span><span class=\"citation-1302 citation-1303 citation-end-1303\">cannot be delivered to PO boxes or postal codes. Shipments are delivered to the Receiver\u2019s address gi<\/span><span class=\"citation-1302\">ven by Shipper <\/span><span class=\"citation-1300 citation-1301 citation-1302 citation-end-1302\">but not necessarily to the named Receiver personally. Shipments to addresses with a central receiving area will b<\/span><span class=\"citation-1300 citation-1301 citation-end-1301\">e delivered to that area.<\/span><\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><p data-path-to-node=\"7\"><span style=\"color: #000000;\"><span class=\"citation-1298 citation-1299 citation-end-1299\">If Receiver refuses delivery or to pay for delivery, or the Shipment is deemed to be unacceptable, or it has been undervalued<\/span><span class=\"citation-1298 citation-end-1298\"> for Customs purposes, or Receiver cannot be reasonably identified or locate<\/span>d, Swift Trust Movers shall use reasonable efforts to return the Shipment to Shipper at Shipper\u2019s cost, failing which the Shipment may be released, disposed of or sold by Swift Trust Movers <span class=\"citation-1297 citation-end-1297\">without incurring any liability whatsoever to Shipper or anyone else, with the proceeds applied against service charges and related administrative costs and the balance of the proceeds of a sale to be returned to Shi<\/span>pper.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><p data-path-to-node=\"8\"><span style=\"color: #000000;\"><b data-path-to-node=\"8\" data-index-in-node=\"0\">Inspection<\/b> Swift Trust Movers has the right to open and inspect a Shipment without prior notice to Shipper.<\/span><\/p><p data-path-to-node=\"9\"><span style=\"color: #000000;\"><b data-path-to-node=\"9\" data-index-in-node=\"0\">Shipment Charges &amp; Billing<\/b> Swift Trust Movers Shipment charges are calculated according to the higher of actual or volumetric weight and any Shipment may be re-weighed and re-measured by Swift Trust Movers to confirm this calculation. Shipper shall pay or reimburse Swift Trust Movers for all Shipment charges, storage charges, duties and taxes owed for services provided by Swift Trust Movers or incurred by Swift Trust Movers on Shipper\u2019s or Receiver\u2019s or any third party\u2019s behalf and all claims, damages, fines and expenses incurred if the Shipment is deemed unacceptable for transport.<\/span><\/p><p data-path-to-node=\"10\"><span style=\"color: #000000;\"><b data-path-to-node=\"10\" data-index-in-node=\"0\">Swift Trust Movers Liability<\/b> Swift Trust Movers contracts with Shipper on the basis that Swift Trust Movers liability is strictly limited to direct loss only and to the per kilo\/lb limits in this Section. <span class=\"citation-1296 citation-end-1296\">All other types of loss or damage are excluded (including but not limited to lost profits, income, interest, future business), whether such loss or damage is special or indirect, and even if the risk of such loss or damage was broug<\/span>ht to Swift Trust Movers attention before or after acceptance of the Shipment.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><p data-path-to-node=\"11\"><span style=\"color: #000000;\">Swift Trust Movers liability in respect <span class=\"citation-1295 citation-end-1295\">of any one Shipment transported is limited to its actual cash value and shall not exceed the greater of:<\/span><\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><ul data-path-to-node=\"12\"><li><p data-path-to-node=\"12,0,0\"><span class=\"citation-1294 citation-end-1294\" style=\"color: #000000;\">$US 100 or $US 20.00\/kilogram ($US 9.07\/lb) for Shipments transported by air or other non-road mode; or<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"12,1,0\"><span style=\"color: #000000;\"><span class=\"citation-1293 citation-end-1293\">$US 10.00\/kilogram ($US 4.54\/lb) for Shipments transported by roa<\/span>d.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><\/ul><p data-path-to-node=\"13\"><span style=\"color: #000000;\">Claims are limited to one claim per Shipment, settlement of which will be full and final settlement for all loss or damage.<\/span><\/p><p data-path-to-node=\"14\"><span style=\"color: #000000;\"><b data-path-to-node=\"14\" data-index-in-node=\"0\">Time Limits for Claims<\/b> All claims must be submitted in writing to Swift Trust Movers within thirty (30) days from the date that Swift Trust Movers accepted the Shipment, failing which Swift Trust Movers shall have no liability whatsoever.<\/span><\/p><p data-path-to-node=\"15\"><span style=\"color: #000000;\"><b data-path-to-node=\"15\" data-index-in-node=\"0\">Shipment Insurance<\/b> Transit insurance is not included in shipping rates, but is available on request and at extra cost. Unless full confirmation in writing is received by the shipper prior to despatch, no shipment will be deemed to be insured for transit.<\/span><\/p><p data-path-to-node=\"16\"><span style=\"color: #000000;\"><b data-path-to-node=\"16\" data-index-in-node=\"0\">Delayed Shipments<\/b> Swift Trust Movers will make every reasonable effort to deliver the Shipment according to Swift Trust Movers regular delivery schedules, but these are not guaranteed. Swift Trust Movers is not liable for any damages or loss caused by delays.<\/span><\/p><p data-path-to-node=\"17\"><span style=\"color: #000000;\"><b data-path-to-node=\"17\" data-index-in-node=\"0\">Circumstances beyond Swift Trust Movers Control<\/b> Swift Trust Movers is not liable for any loss or damage arising out of circumstances beyond Swift Trust Movers <span class=\"citation-1292 citation-end-1292\">control. These include but are not limited to: \u201cActs of God\u201d (earthquake, cyclone, storm, flood, fog); \u201cForce Majeure\u201d (war, plane crash or embargo); any defect related to the nature of the Shipment; riot or civil commotion; any act or omission by a person not employed or contracted<\/span> by Swift Trust Movers <span class=\"citation-1291 citation-end-1291\">(e.g., Shipper, Receiver, Customs); industrial action; and electrical or magnetic damage to electronic recordings.<\/span><\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><p data-path-to-node=\"18\"><span style=\"color: #000000;\"><b data-path-to-node=\"18\" data-index-in-node=\"0\"><span class=\"citation-1290 citation-end-1290\">Warsaw Convention<\/span><\/b> <span class=\"citation-1289 citation-end-1289\">If the Shipment is transported by air and involves an ultimate destination or st<\/span>op in a country other than the country of departure, the Warsaw Convention, if applicable, governs and in most cases limits Swift Trust Movers liability for loss or damage.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><p data-path-to-node=\"19\"><span style=\"color: #000000;\"><b data-path-to-node=\"19\" data-index-in-node=\"0\">Shipper\u2019s Warranties and Indemnity<\/b> Shipper shall indemnify and hold Swift Trust Movers harmless for any loss or damage arising out of Shipper\u2019<span class=\"citation-1287 citation-1288 citation-end-1288\">s failure to comply with any applicable laws or regulations and for Shipper\u2019s breach of the following warranties:<\/span><\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><ul data-path-to-node=\"20\"><li><p data-path-to-node=\"20,0,0\"><span class=\"citation-1285 citation-1286 citation-end-1286\" style=\"color: #000000;\">All information provided is complete and accurate;<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"20,1,0\"><span class=\"citation-1283 citation-1284 citation-end-1284\" style=\"color: #000000;\">The Shipment was prepared in secure premises by reliable staff;<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"20,2,0\"><span style=\"color: #000000;\"><span class=\"citation-1281 citation-1282 citation-end-1282\">Shipper protected the Shipment against unauthorised interfere<\/span><span class=\"citation-1281 citation-end-1281\">nce during preparation and transportation to<\/span> Swift Trust Movers;<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"20,3,0\"><span class=\"citation-1280 citation-end-1280\" style=\"color: #000000;\">The Shipment is properly marked, addressed, and packed;<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><li><p data-path-to-node=\"20,4,0\"><span class=\"citation-1279 citation-end-1279\" style=\"color: #000000;\">The waybill has been signed by Shipper\u2019s authorised representative and the Terms and Conditions constitute binding obligations.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><\/li><\/ul><p data-path-to-node=\"21\"><span style=\"color: #000000;\"><b data-path-to-node=\"21\" data-index-in-node=\"0\"><span class=\"citation-1278 citation-end-1278\">Routing<\/span><\/b> <span class=\"citation-1277 citation-end-1277\">Shipper agrees to all routing and diversion, including the possibility that the Shipment may be carri<\/span>ed via intermediate stopping places.<\/span><\/p><div class=\"source-inline-chip-container luminous-sources ng-star-inserted\">\u00a0<\/div><p data-path-to-node=\"22\"><span style=\"color: #000000;\"><b data-path-to-node=\"22\" data-index-in-node=\"0\">Governing Law<\/b> Any dispute shall be subject, for the benefit of Swift Trust Movers, to the non-exclusive jurisdiction of the courts of, and governed by the law of, the country of origin of the Shipment.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-72ee7c17 e-flex e-con-boxed e-con e-parent\" data-id=\"72ee7c17\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t<div
